Well, 80 percent of you think that groundwater needs to have some form of regulation that's at a level above the current decision makers, and I agree with that. (Oh, and Superman's busy with healthcare reform...)
Bottom Line: Common pool resources (e.g., groundwater) need to be regulated at some level that inhibits the "narrow self-interest of individuals" from harming themselves.Get everyone (overlying the aquifer) in the same room, and come up with rules, norms, etc. (a la Ostrom) that lead to a sustainable use of that resource.

You need to modify your bottom line to add harming others.
@Josh -- harming others is filed under "externalities," which is a different -- but still relevant! -- problem...
If it isn't about harming others, then where does a libertarian have the moral foundation to allow government to regulate someone who may hurt only himself?
@Josh -- "themselves" People in a common pool situation CAN regulate themselves (a la Ostrom) or ask for govt intervention to solve their coordination/free riding problem.
